HA R R I SON CL A R K R ICKE R BY S DIVORCE – STARTING A NEW CHAPTER
108
No one wants to consider divorce. We might try marriage counselling, talking between ourselves and agreeing to give it another go, or even taking time apart. However, sometimes divorce seems to be the only – and best – option.
The pandemic has without doubt caused an increase in divorces. Not enough time away from our spouses may have contributed to this, and what may have started off as something much smaller has grown into something requiring serious action.
HOWEVER, THE QUESTION REMAINS: WHERE TO START?
Divorce proceedings can be painful, and taking the first steps are some of the hardest in the process. If divorce is inevitable, HCR have a dedicated family law team who can help. Regardless of your circumstances, our experts act for husbands and wives to help you start again. We’ll handle your case sensitively, and won’t shy away from complicated matters like high-value assets and businesses, which can often become a sticking point.
Couples who own a farm together, for example, might find their stresses culminating in divorce. These cases are notoriously difficult to resolve – the sale of assets such as the family farm impacts on businesses and livelihoods along with other family members who may be interwoven with the business. An expert family lawyer is required to unpick this very complex area.
In the unfortunate case that welfare issues are involved, our team will work move quickly to protect you, securing injunctions and linking you to local services including GPs, refuges, police, and children’s services.
If you want to start proceedings, we’ll need your original marriage certificate which is uploaded to the court when the divorce is issued. If the case isn’t complicated, this can take between seven and nine months. This sounds like a long time, but we’ll keep you informed at every stage. We’ll also be transparent with our fees, give you a detailed cost breakdown at the start of proceedings, and be at the end of the phone if you have any questions throughout.
Our family law team have a number of skilled lawyers who practice collaborative law. This process involves joint meetings with your former partner and their lawyer in order to avoid the court process and set up a legally binding agreement. This can greatly reduce the cost, time and emotional effort that goes into getting a divorce, and encourages compromise between both parties.
If you feel the time has come to think about getting divorced, our family law team are here to help, providing sensitive, pragmatic advice when you need it most. Our lawyers are experts in their fields, and will ensure the process goes as smoothly as possible.
We want to help you through a difficult period so that you can start a new chapter feeling confident and secure -and we will.
