Federal Contractors and Subcontractors COVID Safety Protocols

n September 24, 2021, the Biden administration issued the
mandatory COVID safety protocols for all contractors and subcontractors with
federal contracts. All federal
agencies have been instructed to include a clause in any covered contract for the acquisition of services or products. It appears that where the subcontract is solely for the provision of products, the Order’s requirements will not apply. Prime contractors, that is those with a contract directly with a government entity, will be covered by the requirements. The order is effective immediately. Federal
contractors and subcontractors with a covered contract
will be required to conform to the following safety protocols:
1. COVID-19 vaccination of covered contractor employees, except where medical or religious reasons provide an exemption (Employees working on a covered contract need to be fully vaccinated no later than December 8, 2021);
2. Compliance by individuals, contractor employees, and visitors with masking and physical distancing in the covered workplace;
3. Designation by covered contractors of a person or persons to coordinate COVID-19
workplace safety efforts in the covered contractor workplace. There will be a phase-in of the requirements for covered contracts as follows: • Contracts awarded prior to October 15, where performance is ongoing – the requirements must be incorporated at the point at which an option is exercised, or an extension is made.
• New contracts – the requirements must be incorporated into contracts awarded on or after November 14.
Between October 15 and November
14, federal agencies must include the clause in all solicitations.
