many risk issues to mitigate, notes David Reischer, Esq., an attorney and CEO of LegalAdvice.com in New York City. He said a school district or private contractor may be accountable for negligent hiring, or failure to train and supervise the drivers. “There needs to be a standard of maintaining the buses in good condition,” he added. “Seat-belts and safety harnesses need to be installed. Drivers must obey all traffic signals and care for children when they enter or exit the school bus. Vehicles need to be inspected on a regular basis. Also, buses must be equipped to accom- modate students with disabilities using wheelchairs. Bus drivers must handle disputes between students with behavioral issues.” The frontier of risk in pupil transportation and school bus travel is more severe than ordinary motor vehi-


cle operation. While school buses are built like tanks, actual transportation operations can be fragile. Any risk is serious, and so is the subsequent liability. While the challenges and issues that contribute to such risk are many, they can be mitigated with smart management and adequate insurance coverage. “Schools have a duty to care for the safety and health


of students who are under their control,” Reischer con- cluded. “As you would expect, this duty extends beyond the classroom to outdoor recreation and school fields, a school-sponsored class trip and naturally, the school bus. Clearly, a school has a duty to ensure the health and safety of students using its school buses.” ●
