Where people enter into a subsequent marriage or relationship and have children from their first marriage or relationship the addressing of the inheritance planning issues that will arise is of considerable importance. It can be a source of concern and stress within their respective families, but with careful inheritance planning, it doesn’t need to be.


The job of an estate planner is to provide legal solutions to potential inheritance issues. Each couple are of course different so a degree of bespoke planning is required but usually there are equitable and fair solutions to be found that ensure that the standard of living of a survivor is maintained for the remainder of their life whilst also ensuring that when they pass away the children of the first deceased inherit what their parent intended them to receive. This type of planning that involves the safeguarding of specific assets after ‘first death’ is not unusual and it brings considerable peace of mind both to the couple themselves and to their respective children. All parties can relax; the survivor can feel secure in their home for the rest of their days and ‘who passes away first’ will not determine which children get what eventually.


A second marriage completely invalidates an existing Will. The newly married couple are back to intestacy which means all their assets pass automatically to their new spouse. Consequently if a second marriage is being planned it is important the couple draw up new Wills of the sort just described ‘in anticipation of their marriage’ with a specific clause maintaining the Will’s validity on marriage. Then they can enjoy their honeymoon and their children need not fret! If you are already in a second marriage or relationship and have no new inheritance planning in place then pick up the phone!
