arrangements, aircraft leasing, ownership and control requirements. This regulation will apply until an air transport agreement with the UK commences or until 30 March 2020, whichever comes first. The UK intends to take a pragmatic approach


by granting EU member states with permission for their airlines to operate with access that is at least equivalent to the rights granted to UK airlines under the EU’s regulation on basic air connectivity. In the longer term there are several potential


options for the UK in pursuing a future relationship with the EU on aviation, including re-joining the ECAA as a non-EU member or negotiating a new ‘open skies’ bilateral deal with the EU. However, negotiating these options is likely to be complicated and some would require unanimous support from each member state. It is also likely that some of the nine freedoms would have to be sacrificed to reach an agreement.


Certificates and licences Certificates of airworthiness, certificates of competency and licences issued by the UK shall be recognised by EU member states in relation to the services mentioned above, providing they conform with the relevant international standards. The UK would recognise EASA certificates,


approvals and licences for use in the UK aviation system and on UK registered aircraft for at least two years following Brexit.

Aviation Security Cargo from the EU to the UK, and from the UK to the EU The UK intends to recognise EU cargo security rules immediately to minimise any disruption to air cargo networks. The EU has also said that it will recognise the UK cargo security regime allowing cargo to continue moving as it does today. These arrangements would apply to airlines flying to or from airports in the EU, Iceland, Norway and Switzerland. The UK will continue to be included in the EU


one-stop-security for cargo. There will be no additional checks beyond what are in place today and cargo screened in the UK will not have to undergo additional security checks on arrival in the EU.


Cargo from the rest of the world into the UK Since July 2014, air carrier stations in third countries are required to have undergone an audit to obtain a designation known as ACC3, which is required for these carriers to be able to fly cargo into or through the EU. The UK will no longer be part of the EU-ACC3 scheme if it leaves the EU without a deal. To maintain security standards, the UK will set


up a separate UK only inbound cargo scheme and the UK ACC3 designations will mirror all existing EU ACC3 designations for cargo flying into the UK from third (non-EU) countries. The UK will maintain the same list of exempt


countries as currently established under EU regulations. In addition, all EU member states, plus Norway, Switzerland and Iceland, will be

The UK has also issued UK-RA3 and UK-KC3 designations to all foreign country cargo handling and consigning entities holding existing EU designations in line with current validity. This ensures that supply chain entities will be able to continue to work in partnership with carriers in respect of cargo destined for the UK.


Customs One of the most significant customs-related changes will be the disappearance of Indirect exports, including the Single Transport Contract for shipments transhipped at an EU airport, consigned on a through waybill to a destination outside the EU. All goods will have to be exported from the


UK and placed into transit for the journey to the airport of departure in the EU, where the transit movement will be discharged. Local procedures will need to be undertaken to complete the export. This change will apply to airfreight


consignments leaving the UK by air and those that are trucked to an airport in the EU by ‘Flight Truck’. For goods moving from the EU to UK for export, the same procedure would apply but in reverse. This article highlights the complex


arrangements underpinning the European air transport industry and the fact that in an immediate no-deal scenario the sector will have reduced market access. The hope is that new arrangements could be quickly re-negotiated that would restore many of the lost benefits.
