Why should I make a Lasting Power of Attorney (LPA)?


You really should make arrangements for the possibility of you becoming mentally incapable of managing your fi nancial and welfare affairs during your lifetime. This is increasingly important as the risk of mental incapacity grows through longevity, illness or accident.


Without an LPA, the Court of Protection may appoint people to manage your affairs, but the complicated procedure will be very costly. More importantly, you will have lost the right to choose who will look after your affairs – when it is vital that they are dealt with effi ciently and sympathetically; and by somebody who knows you.


Lasting Power of Attorney (LPA)


At the time the power is given, the person making it must be capable of understanding its nature and effect for it to be valid. It will be necessary to make separate LPAs, one dealing with your property and fi nancial affairs and the other covering health and welfare decisions.
