I’m buying my fi rst property and the solicitor has told me I need to pay for searches. What searches do I need on my purchase and will they delay things? Cal Fordham.


Hi Cal,


Searches are part of the conveyancing process. They comprise a series of checks made by the buyer’s solicitor to ensure that everything is as it should be.


Searches fall into three main categories:


1. Local searches Taken from the local authority, and are concerned with things like planning issues and major changes to the infrastructure of the area.


2. Specialised and environmental searches These tend to be more important in particular parts of the country – for example, in areas liable to fl ooding, or where there are old mine workings.


3. Land Registry searches


These provide all the ownership information about a property, and reveal whether there are any debts outstanding on it, or anything else of concern, such as chancel repair liability.


Generally speaking, searches have to be paid for upfront. Consequently, it’s worth remembering that if the sale falls through, the buyer will still have to reimburse the solicitor for this outlay.


Delays can occur for any number of reasons. Local authority searches can’t be conducted at the click of a mouse. They require the attention of council staff – so a local authority may be too short-staffed to handle search enquiries quickly, so search times can vary enormously from one area to another. Then again, some solicitors prefer to hold off commissioning searches until their client has received their mortgage offer – just in case the sale falls at the fi rst hurdle!


So if you want to minimise the risk of any delay, get your mortgage offer sorted out as soon as possible – and instruct your solicitor to order the searches right away!
