Issues


The issue in this case is one of civil procedure. The plaintiff asserts that the trial court abused its discretion in denying a motion to continue the trial due the unavailability of the plaintiff’s primary witness. The facts giving rise to the case are that the plaintiff had his vehicle repaired at Metro Muf- fler and two days later his brakes failed causing a collision and injuries to the plaintiff. Plaintiff’s original counsel had withdrawn not long before trial. Trial counsel entered an appearance less than a month before trial and moved at that time for a continuance and renewed that motion later due to the unavailability of a material witness, said witness being an expert designated to testify that appellant’s brakes were improperly repaired which caused the brake failure.

This case involves an altercation between off-duty police of- ficers hired as security by appellant, Central Parking System. Among other claims, the complaint included two counts for federal civil rights violations under 42 U.S.C. §1983. Central Parking suggests that the trial court erred in denying its mo- tion for judgment because there was no evidence to suggest that Central Parking was acting under color of state law or that Central Parking was a state actor.
