In a health care facility which has a policy pre- cluding the co-defendant janitor from entering the rooms of patients during sleeping hours, did the Circuit Court err in granting summary judg- ment in favor of the facility in connection with a negligent supervision count? The defendant janitor was left unsupervised and violated hos- pital policy by entering the plaintiff’s room whereupon he allegedly committed a sexual as- sault on a 66 year-old patient.
