Process The process in Spain is well-tested, and uses the notarial system — ie, title deeds are signed before the notary public. However, the notary gets involved right at the end (ie, signing the title deed), and doesn’t get involved in contracts and searches prior to that point (although quick searches might take place immediately prior to signature, but after you have committed yourself to the purchase). There is no set method for the exchange of contracts like there is in the UK, and similarly there is no standard set of searches carried out. In the UK, we are used to things like coalmining searches and the like, but this is rare abroad.


Beware In order to buy a property with enough land to fl y a plane, you would need to move inland. This shouldn’t raise any particular problems, but your lawyer will need to check on the legality of the property in the fi rst place — does it have planning permission; is it registered? Is it classifi ed as “rural” land? Your lawyer must check it is in the seller’s name, as inheritance is not always formalised in country areas. Thirdly, check on rights of way over the land.
