NRCC Music Licensing Update
EDMONTON – Fitness Industry Canada is currently working with its lawyers to prepare for its upcoming hearings with the Neighbouring Rights Collec- tive of Canada (NRCC) and Copyright Board of Canada. The fi rst phase of “interrogatories”
(defi ned as questions posed back and forth between the interven- ers and the NRCC) begin on July 10. All questions must be answered to each party’s satisfaction; if not, the Copyright Board intervenes to resolve the issue.
Crunch Fitness Files for Bankruptcy
NEW YORK CITY – Crunch Fitness, a gym operator with 73,000 members and clubs in six U.S. cities, fi led for bankruptcy protection from creditors in New York, citing slow- ing membership sales and overpriced leases for some locations. Crunch seeks to sell its assets through an auction under court protection, to New
Evolution Fitness Company, formed by CH Fitness, a joint venture formed by a New York-based fund manager and a private equity fund called NEFC Crunch. The sale “will allow Crunch to emerge as a strong player focused on what we have
become famous for: being the place where entertainment meets fi tness,” says Tim Miller, Crunch CEO. Most of the gym’s locations continue to operate, with the excep- tion of one midtown Manhattan club The gym lost $11.2 million in 2008 and has had $2.8 million in losses since the be- ginning of the year.

FIC will fi le more than 200 pag- es of initial questions to the NRCC. The answers will help FIC to form the basis for its defense against the proposed music Tariff . During this time the NRCC will also be able to pose questions to FIC and all other intervenors. It is expected that the NRCC will be asking ques- tions which will require signifi cant research and capital to answer. FIC is working closely with Fitness Australia which recently fi nished its fi nal hearing with the Phonographic Performance Com- pany of Australia, which proposed a similar Tariff in 2006. During the trial period, Fitness Australia produced enough data and research to fi ll fi ve shopping carts. This re- search has been provided to FIC and it could save the association thou- sands of dollars in research fees.
