Increased scrutiny from agencies as governments globally continue to interpret law and policy concerning outbound migration more strictly has meant that companies are struggling to keep up with the legal developments and the compliance challenges. In light of recent immigration developments and with business immigration rising over the past year, we speak to David Nachman from The Nachman Phulwani Zimovcak (NPZ) Law Group, P.C.

avid began: “Clearly the most interesting trend in U.S. Business Immigration Law is President Obama’s commitment to


Comprehensive Immigration Reform (“CIR”).


“The recent initiatives under the Deferred Action and Childhood Arrivals (DACA) Program in August 2012 seemed to be the precursor of a DREAM Act. Prospects of CIR could present immigration law options for the over 11 million undocumented foreign nationals in the U.S. The Nachman Phulwani Zimovcak (NPZ) Law Group, P.C. continues to monitor CIR and the impact that it may have on our Nation.”


David continued: “The second trend in Business Immigration Law continues to be the focus on worksite enforcement. Worksite Enforcement activities take the form of (1) U.S. Department of Labor (DOL) Audits and Investigations against H-1B and other employers; and (2) Site Visits by Agents from the Office of the U.S. Department of Homeland Security (DHS), Fraud Detection and National Security (“FDNS”) with regard to H-1B, Professional and Specialty Occupation Worker Visas


and R-1, Religious Worker Visas (and others); and (3) I-9 Audits and Investigations from the Immigration and Customs Enforcement (ICE) Office.


“The NPZ Law Group, P.C. continues to provide its U.S. employer clients with advice about I-9 Form policies, Social Security Mismatch Compliance and E-Verify and IMAGE compliance. A new I-9 Form was promulgated in May, 2013. Also, E-Verify may be mandated under CIR. NPZ continues to assist employers and employees to avoid immigration- related civil and criminal liability.”


David added: “Another key trend in immigration law focuses on bringing the “brightest highly-skilled workers” to the U.S. from abroad. This trend was clearly highlighted by President Obama in a recent speech. He said: “So we don’t want the next Intel or the next Google to be created in China or India. We want those companies and jobs to take root here . . . Bill Gates gets this and he knows a little something about the high-tech industry".


“President Obama also said, “The United States will find it far more difficult to
