How should people ensure they are protected against copyright infringement?


In the absence of a formal registration system for most copyrighted works in Turkey, copyright holders should be able to prove their earlier rights over the work in order to be protected against possible infringements.


What is the best way to deal with infringement, and what are the costs associated with it?


Te best way to deal with infringement is to take action in civil and criminal courts. In case of exploitation of


the work by reproduction


without permission of the right holder, it may be claimed that the reproduced works and devices enabling the reproduction should be destroyed or surrendered to the right holder in return for equitable remuneration not exceeding their cost. Alternatively, the copyright holder may claim the payment of three times the amount that would have been paid if a contract had been concluded between the parties.

Counterfeiting How big a problem is counterfeiting in your jurisdiction? Counterfeiting is a serious and common problem for Turkey. Besides the Turkish counterfeiters who imitate a wide range of products, Turkey is also an entry point for many counterfeit products destined for other markets.


What industries are particularly at threat? Most counterfeited products in Turkey are textile products, accessories such as handbags, computer programs, and all kinds of movie and music DVDs.


What are the best strategies for dealing with the problem?


To deal with counterfeiting, the right holders may initiate civil and criminal actions. Customs actions may be used as well.

Are there any legislative changes to the IP regime that would make life easier for businesses? Te present patent Decree Law is to be replaced by the draſt law on patent protection. It has to be noted that, according to the current patent system, there are two different systems for granting patents: the system for granting a patent without (substantive) examination and the system enforced by most of the European countries, ie, granting a patent with (substantive) examination. According to the draſt law, system granting


the patent without substantive examination is to be abolished.


Moreover, according to the draſt law, the 98/44/ EC European Directive of

implemented. Tis change is in accordance to the acquis communautaire and will enhance business life and legal certainty.

Professor Hamdi Yasaman has lectured at the Galatasaray University faculty of law, commercial law department. Yasaman has published numerous books and articles in corporate law, commercial enterprise law, security exchange law, capital market law, banking law and intellectual and industrial property.


On the other side, the present trademark decree law is to be replaced by the draſt law on trademark protection. However, we cannot give any exact information about the transposition of the said changes into Turkish law.
