Charles Gibson QC


Charles Gibson QC, is identified in the legal directories as a leading silk in commercial litigation, product liability, health and safety, environmental law and consumer law.

e has been recognised as the leading silk in Product Liability Law for the last 7 years and has developed and devised many of the directions and


procedures now used in Group Actions.


He has acted in major domestic and international group actions for over 25 years involving cases which have complex commercial, product liability and medico-legal issues, attract significant publicity, are highly emotive and often involve multijurisdictional proceedings.


The past year has again seen Charles excel professionally. He is the "go to" silk for any entity involved in significant, high value, commercial and personal injury group litigation.


Charles is head of Henderson Chambers.


2011 saw Charles leading major cases of significant importance and public interest with regards to claimants cost awards and limitation. Two bench mark cases in the last year have been Motto & Others v Trafigura and the Atomic Veterans Litigation.


Atomic Veterans Litigation: Charles Gibson QC represented the Ministry of Defence in the high profile claim for injuries brought by approximately 1,000 servicemen, who were involved in atomic tests in the 1950s. In the Supreme Court Charles persuaded the majority that the claims were time barred, moreover, all 7 justices hearing the appeal were unanimous in the group’s overall lack of prospects of success (ruling that no extension to Fairchild would be made).


The Trafigura litigation: the largest environmental group action in English history brought by 30,000 residents of the Ivory Coast claiming injuries as a result of the dumping of waste oils. The case gave rise to what is thought to be the largest claim in costs in English legal history (£105 million).


The OCENSA pipeline litigation: a group action brought by over 100 Colombian farmers claiming environmental damage as a result of the construction of an oil pipeline.


Austin v Miller Argent: a group action by local residents against a mine owner involving noise and dust pollution.


Consistently ranked first in the Directories, members the Product Liability and Group Actions group have been involved in a series of high profile and ground breaking cases: Seroxat, Foetal Anti-convulsants, Thalidomide, PIP Breast implants, Accomplia, Taxi engine fires, Hip Implants, MMR, Miners Knee and Isolagen. Chambers was named “Product Liability Law Practice of the year” in the UK 2010 by Corporate INTL.


Voted “2010 Health & Safety Chambers of the Year” and finalist in 2011 by Chambers and Partners and ranked in the top tier in Chambers and Legal 500, members of Chambers’ Health & Safety group appeared in some of the most important health and safety cases of the past year, including: the Grayrigg inquest, the Potters Bar prosecution, HSE v UK Coal, the prosecution of Marks & Spencer’s for asbestos contamination, the prosecution of Shell for gas explosion and the defence of UK Power.


The Environmental Law team have been involved in many of the largest environmental group actions brought by foreign nationals in the English courts. This has been a growth area in recent years and Chambers has been involved in all the largest cases.


A leading set in Consumer Law, with a strong team, at all levels of seniority, specialising in consumer credit and other consumer protection.


Other cases have included: Tabra v Montererrico Metals: a group action by Peruvian nationals claiming environmental damage and human rights abuses from mining activity.
