Better regulation of the bailiff
industry is now the subject of a major public consultation headed by the Ministry of Justice (MoJ). The BPA is working closely with the MoJ and the bailiff sector to ensure that appropriate changes to the law are made in the best interests of protecting the consumer, while ensuring that civil enforcement can be undertaken fairly and reasonably. The BPA has been a major partner in the development of the Blue Badge Improvement Service (BBIS). The BBIS will promote better administration and distribution of the badges, meeting our objective of better administration of the scheme and fraud prevention. Next we need to improve enforcement to ensure that only those who have a genuine need have access to designated spaces and facilities. The Welsh Government is preparing legislation to improve the administration of civil parking enforcement by introducing a standard penalty charge notice (PCN).

Another success is the government’s consultation on simplifying the Traffic Regulation Orders (TROs) and scaling back on the rules governing traffic signs. We live in a multi-channel communication world and the future of TRO advertising must reflect this. The present arrangements are costly, duplicative, and sometimes ineffective. The important point is that consultation is undertaken to ensure that the democratic process prevails – how this is achieved is not something which government should be dictating. The TRO advertising requirements should provide a framework of best practice, which ensures that proper consultation is undertaken, but with local decisions about which channels to use. Finally, we have been successful in raising awareness of the need for proper inspections and maintenance of the UK’s parking structures, but there is still much to do before we can be sure that Britain’s ageing parking structures are genuinely funded, so that intended life expectancy of the car park can be achieved if not extended.
