John Giust is a litigator and electrical engineer. He has led trial teams in civil and patent cases at various US District Courts and at the U.S. International Trade Commission. He has successfully resolved


cases for both patent holders and accused infringers in jury trials and in administrative proceedings. He has taught intellectual property law at the University of San Diego Law School and he also lectures on international IP law issues. John has been listed in Best Lawyers in America for Litigation - Patent since 2011 and as a San Diego Super Lawyer in Intellectual Property Litigation since 2009.


John received a B.S. in Electrical and Computer Engineering from the University of New Hampshire. While attending law school, John worked as a patent examiner at the U.S. Patent and Trademark Office. He has a J.D., summa cum laude, from the American University, and an LL.M. in patent and intellectual property law, summa cum laude, from the George Washington University.


John has substantial courtroom experience in front of juries and judges. He has been lead trial counsel and has participated in trials in many venues. He has handled cases in the Eastern District of Texas, District of Delaware, Eastern District of Virginia, Southern District of California, and at the USITC as well as many other jurisdictions.


As an electrical engineer, John is experienced in analyzing and presenting complex concepts to juries and judges, often using graphics, animations, and demonstrations. He has a reputation for trial strategy and efficiency, getting to the heart of the issues quickly and economically.


John has handled cases for both large and small companies, all of whom rely on his expertise when the case is important or unduly complex. He has handled cases in the semiconductor, computer, RF, networking, SAN, printing, consumer electronics, imaging and gaming industries. He has handled cases for both US companies and foreign entities.


When a case turns on issues of technology, code, or industry practices, clients turn to John for his experience and trial readiness.

Mr. Giust’s Notable Cases ❚ Certain probe card assemblies… 337-TA-621 (U.S. International Trade Commission). First chaired trial on behalf of Respondents accused of infringing multiple patents on semiconductor probe cards. After a full hearing, successfully won on non-infringement, domestic industry and numerous asserted claims were found invalid over prior art.


❚ Microsoft v. Lucent Technologies, 02-cv-2060 (S.D. Cal). Represented Microsoft in one of the largest and most complex cases in patent law history. After a jury found Microsoft liable for over 1.5 Billion dollars in damages, the judge overturned the verdict resulting in no liability, which was upheld on appeal. The case concerned patents on audio codec technology.


❚ Microtune, Inc. v. Broadcom Corp., 4:01-cv-23 (E.D. Tx), Represented Microtune in a series of cases against Broadcom regarding Microtune’s patented semiconductor tuner technology. Won a jury verdict of willful infringement in the E.D. Texas, and a separate ITC case brought in retaliation by Broadcom. Argued at U.S. Court of Appeals for the Federal Circuit.
