LATINO AMERICA La privatización de la Lotex
La inclusión del proyecto en el PND fue recomendada al Presidente de la República mediante la Resolución No 134/2020 del CPPI, publicada el 19 de junio en la Gaceta Oficial. El Banco Nacional de Desarrollo Económico y Social (BNDES) ha sido designado como el ente responsable de supervisar el proceso de privatización en coordinación con el Ministerio de Economía, tal como se hizo con la Lotería Instantánea Exclusiva (Lotex). Sin embargo, la agenda del proyecto que contiene más información y fechas sigue pendiente de publicación en el sitio web del PPI. La normativa vigente determina que la lotería es un servicio público
exclusivo del Gobierno nacional, cabiendo al Ministerio de Economía autorizar o conceder su explotación (Ley No 13.756/2018). La Ley Federal establece la asignación del formato de acuerdo con el medio que se utiliza para la apuesta (en entorno físico o virtual). A la fecha, aún sigue pendiente la reglamentación de las apuestas
deportivas. La elaboración del Decreto está en curso desde 2019, y se han realizado algunas Consultas Públicas promovidas por la Secretaría de Evaluación de Políticas Públicas, Planificación, Energía y Lotería (SECAP) del Ministerio de Economía, y que aún siguen abiertas con el propósito de ampliar el debate del proyecto de la reglamentación. Durante las Consultas Públicas, se han recibido muchas contribuciones de diversos agentes, asociaciones y profesionales de la industria. La tercera y última Consulta Pública de SECAP se realizó en marzo de
este año, motivada por el cambio en el modelo de explotación del servicio. Este servicio previamente iba a ser mediante autorización, más tras el análisis de la Procuraduría General de la Tesorería (PGFN), esta vio la necesidad de cambiarla para que se establezca como una concesión pública. En junio pasado, el Subsecretario responsable de la cartera del
Ministerio de Economía declaró que la intención del Estado es que la reglamentación de las apuestas deportivas quede lista para finales de este año. Aparte de una nueva consulta pública reciente, causada por la pandemia, se observa un retraso en la conclusión del Decreto reglamentario. Debido a que no se tiene el reglamento, existen algunos asuntos que
generan molestias al inversor extranjero. Uno de ellos es la cuestión fiscal, ya que el Decreto debe adaptarse al tipo previsto en la ley, puesto que en el pasado han existido divergencias que han sostenido reñidos debates. Otro asunto de atención es el hecho de que existen negocios en algunos estados brasileños que operan con el soporte de procesos judiciales concedidos por demandas judiciales, y estos ya no podrían seguir operando tales loterías. Ciertos existentes rezagos negativos en reglamentación fueron
abordaron durante la problemática subasta de la Lotex, que fue incluida en el PPI en la 1a Reunión del Consejo a finales de 2016. Siguiendo estudios del proyecto por el BNDES, la concesión fue aprobada en la 3a Reunión, bajo la modalidad de privatización. Con el inicio del proyecto en 2017, este sólo pudo concluirse en
octubre de 2019, después de varios aplazamientos y suspensiones debido a la falta de interés en el proceso. Finalmente, la concesión de la Lotex fue otorgada al Consórcio Estrela Instantânea, conformado por las empresas International Game Techology (IGT), de origen italiano, y Scientific Game International (SGI), de origen estadounidense. “Seguridad jurídica para atraer inversión extranjera” La concesión de la Lotex fue un primer paso hacia la apertura del
mercado brasileño de loterías, y aunque siguiendo un proceso complicado, demostró en la práctica que existe la posibilidad de avanzar en este sector originando los primeros debates sobre el tema. Esto ha sido demostrado haciendo referencia a la excelente reciente decisión del Tribunal de Cuentas de la Unión (TCU), que examinó la segunda y tercera fase del proceso de desnacionalización de dicho servicio público y ha atestiguado que se han cumplido los requisitos y formalidades en el

been designated as responsible for supervising the privatization process in coordination with the Ministry of Economy, much in the same way as it did for the privatization of Loteria Instantânea Exclusiva (Lotex). Nevertheless, the calendar with additional information and dates is pending publication on the PPI website. Current regulations determine that lotteries are exclusive public services of the Federal government, and it is up to the Ministry of Economy to authorize or grant its exploitation (Law no. 13,756/2018). Brazil Federal Law establishes the allocation of the betting format in relation to its format physical or virtual environment). Although regulations for sports bets is still pending, drafting of the Decree has been in progress since 2019, with some Public Consultations promoted by the Secretariat for Evaluation of Public Policies, Planning, Energy and Lottery (SECAP) of the Ministry of Economy, on an open basis for the purpose of discussing the regulatory draft. During the Public Consultations, many contributions were received from various industry agents, associations and individuals. The third and last SECAP Public Consultation was closed in
March this year, and was driven by the change in the model of exploitation of the service, which previously would have been granted by authorization and, following further study by the Attorney General’s Office at the National Treasury (PGFN), the need to address the issue by public concession was approved. Last month, the Undersecretary responsible for the portfolio at the Ministry of Economy declared that the intention is that regulations of sports betting will be ready by the end of this year. Also, the new recent Public Consultation was affected by the pandemic, and a delay in the conclusion of the Decree ensued. There have been some uncomfortable issues generated to
foreign investors owing to delays in the sports betting regulation process. One of them is the tax issue, as the Decree must be adapted to the tax rate provided for in law because in the past there has been contradictions on this matter. Another point of attention is the fact that there are some sports betting operations in some Brazilian states that are supported by injunctions granted through lawsuits, and they would not be able to operate under new regulations. Some existing controversies that existed on sports betting were
addressed during Lotex’s troubled auction. State lottery Lotex was included as part of the PPI at the 1st Council Meeting at the end of 2016 and, following BNDES studies the concession of the instant lottery was approved at the 3rd Council Meeting as a privatized business. The Lotex privatization project began in 2017 and was only completed in October 2019 after several postponements owing to the lack of interest in the proposals. Finally, the concession was granted to Consórcio Estrela Instantânea, a society formed by global gaming leaders, International Game Techology (IGT), of Italian origin, and Scientific Game International (SGI), of American origin. “Legal certainty to attract foreign investment” The Lotex privatization was a first step towards the opening of
the Brazilian lotteries market. Even with a complicated procedure, it was demonstrated in practice the possibility of progress in this sector and with this the first discussions on the subject were promoted. A good point of reference was the recent decision by the Federal Court of Auditors (TCU) which reviewed the second and third stages of the process of denationalisation of that public
