' ;Mr Nick McNamara (prosecuting) said: “The central purpose of the Animal By-Product Regula- tions is one of disease control. “The regulations do not permit farmers to leave carcasses to rot in the field, or dispose of them by
r burning in open pyres." He added how on April 10th; officers came across
a two-year-old Belgian Blue heifer with no ear tags and bn three separate occasions, officers advised Carr that the animal should be ear-tagged,

discovered a cow which was ill, in the main shed. When they spoke to Carr, he informed them that the cow had been treated by a local vet, however Carr had failed to make a record of what medicinal products the vet had administered.-'.' ' During Carr’s second interview with Trading
Standards, he admitted that he had failed to record the births of two calves in his herd register. “This failure would undoubtedly have hindered
the authorities had it become necessary to establish animals’ identities and current whereabouts,” said Mr McNamara.
Mr Barry Dealing (defending) explained to the
court how due to a wet-winter and spring 2008, a number of
famis.in the. area were affected by Liver Fluke Disease (a parasitic disease found worldwide ■ affecting sheep, goats, cattle and buffalo). “Although Mr Carr, was aware tha t he had fallen
sheep, he failed to take heed of what trading stan dards officers had said. He tried td incinerate them on his farm and he accepts that was wrong.” Mr Hearing added how his client had tried to tag
the Belgian Blue heifer but it had become “boister ous” and therefore he decided to take it to the Gis bum Auction Mart. He a l^ explained how Carr was' unaware that he had to keep a note of any medicinal treatment given to animals. 4 r He added: “Mr Carr was borri'in the Kibble Val
ley and left school at'the age of 15. He had limited education. Record keeping is book work and it is not very easy for him. I t ’s difficult to keep a track of records of the movement of the livestock;' ■ “Mr Carr has reduced significantly his stock lev
els because he appreciates a t 70 he cannot get around all his stock. He farms in partnership with his sister and the farm hardly makes a profit and there is no modem machinery.” ' . Magistrates fined Carr a total of £1,000 and £806
costs. The chairman of th e bench, Mr Geoff Knowles, said: ‘,‘This fine reflects the seriousness of the case.
