N O T IC E IS H E R E B Y G IV E N T H A T the Ribble Valley Borough Council (“the Council") propose to make an order under section 2 of the above Act designating land described In the Schedule below for the purposes of the Act. Th e effect of such designation would be that an offence would be committed under section 3 of the Act if a person in charge of a dog which defecates at any time on the designated land does not remove the faeces from the land forthwith, unless that person has reasonable excuse for failing to do so, or the owner, occupier or other person or authority having control of the land has consented


to his or her failing to do so. A person guilty of such an offence would be liable on summary conviction to a fine not exceeding level 3 on the standard scale (currently


£1,000). Th e provisions of section 3 of the


Act do not apply to registered blind persons. Section 4 of the Act gives the Council power to operate a fixed penalty scheme for an offence under section 3 and it is • the Council's intention to do so. S C H E D U L E
