SIX-FIGURE SETTLEMENT FOR OFFICER INJURED IN ON-DUTY ACCIDENT


Successful claim for Federation member injured in collision


Waldrons Solicitors, a Police Federation panel firm, have recently successfully concluded a civil claim for compensation on behalf of a member who suffered significant injuries as a consequence of an on duty road traffic collision. At the time of the incident the


member was the driver of a marked police vehicle when it was struck by another vehicle, which was being pursued by the police. He sustained multiple injuries including fractures to his ribs, vertebrae and shoulder. He also suffered psychologically. Surgery was required and the member remained absent from work. One of Waldrons’ solicitors visited the


member at home to discuss the incident and explain the claims process, reassuring

the member that if successful he would keep 100 per cent of his compensation. A claim was intimated on the member’s behalf to the defendant insurer and liability was admitted swiftly. Waldrons persuaded the insurers to make an interim payment to the member and also to investigate whether he needed any private rehabilitation. The member remained absent from


work until further surgery was carried out. He was continuing to lose overtime and allowances while absent. Although the further surgery was successful enabling the member to return to work, he still had residual symptoms and there was some risk of future complications. Waldrons obtained medical evidence


from a Consultant Orthopaedic Surgeon and Consultant Psychiatrist. Further MRI, CT and ultrasound scanning


was requested by the orthopaedic expert. Once these investigations were completed, Waldrons instructed a barrister to advise and prepare a schedule of the member’s past and likely future financial losses. The member’s claim included


compensation for his injuries, loss of overtime and allowances, care and assistance, inability to undertake certain DIY activities, medical treatment and potential future disadvantage he may face on the open labour market. The medical evidence and Schedule


of Loss was served by Waldrons on the defendant’s solicitors and a six-figure settlement was reached two weeks later. Given his membership of the Police


Federation, the member was able to keep 100 per cent of his compensation.
