The EU shores up its governance of the automotive sector After diesel gate broke out in September of last year, it was on the cards, expected and perhaps long overdue. However the European Commission has moved faster than many people in Brussels had expected. In less than 4 months the Commission services prepared a new type approval regulation replacing the old frame work directive. Contrary to the old directive the new regulation is directly applicable. Meaning it no longer would need to be transposed to national law.


Besides this important legal change the new type approval system proposed some important substantive governance changes. These can be grouped in three categories;


1. Ensuring better enforcement and market surveillance. The new proposal limits the validity of type approval certificates to 5 years. Should a vehicle be sold for a longer period the OEM will have to re-apply / renew it. It also obliges market surveillance authorities to carry out spot checks on vehicles already in circulation in the market. Lastly the proposal requires that all documentation be made public by type approval authorities.


2. Strengthening the quality of testing and technical services, in order to become a recognised technical services provider the body needs to prove among other things that it is independent, document their skills and technical knowledge and get audited by three national type approval authorities and the EU Commission. Last but not least their license is only valid for 5 years and the technical service may not receive direct payment from vehicle manufacturers. Member states will be tasked to collect those fees on their behalf.


3. Introducing oversight in the type approval process, this not only creates an EU forum for information exchange between type approval authorities and the EU commission but also imposes a series of fines for automobile manufacturers of up to 30,000 Euros per vehicle or system that are held to be non-compliant. Meaning if 11,4 million vehicles, by your own admission, are said to be non-compliant you can imagine the bill.


Aside from these 3 main elements and the huge financial deterrent, the new proposal also contains provisions on access to repair and maintenance information that are currently laid out in the Euro 5-6 Regulations. It’s on this very last point that UEIL will step up its dialogue with the EU authorities in the coming weeks and months. So as to improve our access to technical information. In our assessment this proposal is a real improvement to the way the industry is governed.


More transparency, independence and openness are welcome. Let’s hope it never comes to the monstrously high fines as proposed by the EU Commission because that could literally kill off the industry that it tries so hard to govern.

Italy formally requested that the Presidency included on the agenda of the Excise Committee which was held on 30 and 31 May the topic ‘inclusion of all lubes under EMCS’. More and more EU Member States seem to be willing to agree on the inclusion of all lubes under EMCS as tax authorities of certain

EU Member States stated that fraud with lubes has allegedly increased in recent years (UEIL will investigate this matter to gather further evidence of these claims). The decision will be taken by qualified majority.


The UEIL position is against this proposal and therefore will increase its outreach activities to secure a blocking minority. Actions are already planned – don’t hesitate to contact us for further information.


Technical & Competition Committee The Technical Committee recently met in Brussels on 27 January 2016.

The Technical Committee, together with The Competition Committee is currently investigating: • Industrial - 2 Cases • Off Highway - 10 Cases • PCMO - 10 Cases • HDDO - 4 Cases


The latest Technical Committee meeting was held in Brussels on 25 May 2016.
