Government & Housing Legalities

LEGISLATIVE UPDATE By Charles Tassell, Director of Governmental Affairs

“Now this is not the end. It is not even

the beginning of the end. But it is, perhaps, the end of the beginning.” ~ Winston Churchill

Amazing the changes in the past few Charles Tassell

weeks. Outside of the medical field, very few people even knew the term co-mor- bidity. Now it is tossed around on the news channels as an assumed term. Similarly, business is changing. Covid-19 and the

various policies addressing it have impacted our national psyche in ways that will take years to unpack. Social distancing aspects will be incorporated into our business, transactions and recreation. As we cross the threshold from stay-at-home to re-opening, the specter of future closings must weigh heavily on our plans. The Greater Cincinnati Northern Kentucky Apartment Association (GCNKAA) is committed to assist all our members in successfully navigating the various - often vague - policy changes that will con- tinue to develop. More than this page, please track the Covid-19 banner link at the GCNKAA.org website, as well as participate in the bi-weekly calls. From the board leadership to the staff, we are trying to provide the most up-to-date information available.

Regrettably, that information is sometimes changing as fast as we share it!

I have had the honor of being on a couple of calls with Vice

President Pence, and he reiterated the federal urging of states to replicate the federal program of letting each area open according to its rate of infection. This means that as states open, there may be an increased propensity for various counties and cities to have differ- ing levels of restrictions. I know this will cause confusion, but we will try to provide updates to help clarify as the restrictions occur or are lifted. Please make sure staff are fully knowledgeable about the municipal and county lines, as they may become substantially more important – especially for limited and targeted responses to second or third waves of infection. While the Best Management Practices are being updated, it would be helpful to hear from members on the problems (and solutions) you are facing. With no small amount of relief, I am pleased to share that in our region we are seeing minimal requests for workouts, with non-payment issues primarily isolated to the expected problem children we might have already had. Leasing and maintenance, due to their engagement with the public, are our front lines, and, as such, we encourage the incorporation of Health Department recommendations on distancing (6’ when possible) and masking for the protection of all. A note on masks: they are not to prevent you from getting

sick. They are to prevent an asymptomatic person from coughing or sneezing and inadvertently ejecting the virus into the immediate area. Hand washing and not touching your eyes, nose or mouth are the best ways to make sure you don’t pick up the virus that was injected into an area and is residing on a surface…for 12-72 hours. Hence the cleaning of hands and surfaces! As such, any type of covering that blocks the nose/mouth from “sharing” the germ is sufficient.

Additionally, each business can set their standard of care,

as long as the Health Department guidelines are followed as a minimum. For example, some stores limit access and numbers of people, while others require masks of customers, etc. Please think through the process and the goal or exit strategy of when that process may end. For example, pools and community centers are closed by order of the Governor of Ohio for now. When the restrictions are lifted, how will social distancing and cleaning (not sanitizing) be incorporated into their regular use? In fact, how will your business change going forward? Finally, I would be remiss if I didn’t mention that as an asso-

ciation we have been quietly working with local and state officials to open the courts in varying capacities, while opposing numerous mandates, moratoriums, and well, forbearances distinctly unaf- filiated with reality…was that a kind enough way of saying it? If you hear of local efforts that could impact the membership, please email (or call) as soon as possible! I can be reached by email at charles@gcnkaa.org.
