Joint Accounts - Might the survivor be just a trustee?
MOST people probably think they know the answer to the question in our heading, but the matter has never been en- tirely free from doubt. It may now be quite clear. By his Will a wealthy busi- nessman in the Bahamas left his freehold estate in Nassau to a close friend “M”. His re- siduary estate passed, by his Will, equally to M plus two others. Shortly after making his Will the businessman made M a joint account holder of his bank account containing $190,000.00. The bank’s application form contained some very clear di- rections: “unless otherwise agreed in
writing...all money... is our joint property with the right of survivorship. This means that if one of us dies all money in the account automat- ically becomes the property of the other account holder....” Nothing could be clearer -
except that the residuary ben- eficiaries argued that the close friend might well be the owner
of the account, but was he in fact as a trustee for all three of them?
Constitutional lawyers will
know that foreign appeal cases such as this are heard before our Privy Council, and in this case the trial judge agreed with the Bahamian Court of Ap- peal, that the Testator, through the bank’s detailed application form, fully constituted the ac- count as a joint asset in all re- spects and there was no room for any trust for anyone else. The judge ruled that al-
though in some cases it was necessary to unravel the ori- gin and contribution of funds into the account, this was not needed in this case as the sub- jective intention of the testator was perfectly clear. For more advice about survi-

With quill in hand, Wayne spent many months putting together the madcap medieval romp, which was originally performed as a three-night, sell-out run at the Leiston’s prestigious cinema and theatre in September 2016, to the enjoyment of all those who were lucky enough to get tickets. Shortly after, Wayne was in-
vited to bring the show to the stage of Felixstowe’s popular Spa Pavilion Theatre, which re-opened its doors in 2015 and now, the cast are busily prepar- ing for their outing to the sea- side on Friday 26th October, for the special one-off performance

HAMMOND Isuzu, Hales- worth, continue to employ two of Britain’s best technicians. For the second consecutive year, the Suffolk based dealer- ship entered Lee Cayley and Aaron Fenn into Isuzu’s World Technician competition. To qualify, they had to pass a writ- ten examination. Having qualified for the Brit-
ish finals, they were both short- listed amongst the top Isuzu technicians in the country. The finals took place in July, where both Lee and Aaron competed at the IM Group headquarters in West Bromwich. What followed included an intense day of prac- tical and written examinations starting at 8am in the morning finishing 4pm in the afternoon. Throughout the day, they were
examined on both electrical and mechanical faults. Every assess- ment was analysed by two examiners and a photographer. One of the practical exams included a non-starting vehicle; which had a different fault from the previous year. The techni- cians had an hour to diagnose, repair the vehicle using the cor- rect procedure, and complete a written report. Lee won the competition with
Aaron taking a close third. Lee will now be going on to compete in the Isuzu World Technician Finals, which takes place in Thailand later this year. Paul Marjoram, Dealer Princi-

Arts Festival and Big Draw
IT’S back! The second Big Draw and Arts Festival will be held on Saturday 20th Octo- ber when the centre of Wick- ham Market will be a stage for a feast of art activity from drawing workshops to inspira- tional art exhibitions. The event promises an explosion of talent with fun and interest for all ages and abilities. Experience the pleasure of drawing and be part of over 400,000 people participating each year in The Big Draw. The Village Hall and the Hill will be hosting various art workshops where you can let your creative juices flow.
