JamesI having survived the Gunpowder Plot on his life by Guy Fawkes and his accomplices on 5th November 1605. Since then the celebrations have developed from being known as Gunpowder Trea- son Day, to the modern Guy Fawkes, Bonfire or FireworksNight.
Just asthe name has changed over time, so too has the lawonthis subject. It’s importantthat retailersand consumersfamiliarise themselves with the legislation fully as the following is only
aquick guide.
Retailers: To storeorsell fireworksyou must registerorob- tain alicence from Trading Standards and offer them forsale forafew weeksoverthe Bonfire Nightperiod, namely 15thOctober to the 10th November. To sell fireworksat any other time of the year (other than at times of other celebra- tions), youneed alicence from either the local
council or the local fireservice. To storeorsell over 2000kg of fireworks, alicence is needed from the Health &SafetyExecutive. Youmustnot sell fireworksto under 18’sand all fireworksmust comply with British Safety Standards.
Consumers:
You mustbeover18yrs to buy fireworksand they mustbeboughtfromregistered sellersfor private use on the datesmentioned above.Under 18’s cannot be in possession of a firework and they mustnot be set off or thrownin apublicplace, this attracts a fine of up to £5000, or an “on-the- spot” fine of £90. Alwayscheck youare buying fireworkscertified as meeting the British Safety Standards (displayed on the packaging).
