Dorado Hills Condominium of Unit Owners (“Dorado Hills Council”) and Comanco, Inc. (“Comanco”) appeal the decision of the Circuit Court for Anne Arundel County on summary judgment in an insurance coverage action. Appellants contend that the Circuit Court misinterpreted the terms of the insurance policy and misapplied the long- standing rule under Maryland Law that a mere “potentiality that the claim could be covered by the policy” is sufficient to trigger the duty to defend a policyholder under a liability insurance policy. Te Circuit Court denied Dorado Hills’ and Comanco’s motion and granted State Farm’s cross-motion for summary judgment, holding that State Farm did not have a duty to defend the Dorado Hills Council and Comanco in the underlying action, thereby prompting the present appeal.

Tis case arises out of a motor vehicle accident. Appellant alleged that she was a passenger in an automobile that was struck in the rear by the Appellee. Appellant filed a lawsuit seeking


compensation for her injuries. Following the


introduction of all evidence, respective counsel met with the trial court to discuss jury instructions. Appellant proposed a jury instruction presuming that in a rear-end automobile accident there is a presumption of negligence on the part of the rear driver. Te Court elected not to include the instruction. Te Court preferred pattern jury instructions. Appellant alleges the Court erred in failing to read her proposed jury instruction.
