Gambling Law
The online gambling industry in Malta is regulated by the Lotteries and Other Games Act and, more specifically, the Remote Gaming Regulations (the ‘RG Regulations’), originally introduced in 2004 as a first for the European Union. The Lotteries and Gaming Authority (the ‘LGA’ or ‘Authority’) is the single regulatory body responsible for the supervision of all gaming activities in Malta including but not limited to remote gaming.
Gaming within Gibraltar is however governed principally by: (1) the provisions of the Gambling Act 2005, (“Act”) (2) the terms and conditions of the relevant licence(s) (usually a remote gaming licence for casino and a remote gaming licence for fixed odds betting) (“Licence”) and (3) all applicable codes of practice
(Generic Code, AML Code, Remote Technical Standards, (“Codes”)). All licence holders must comply with the Act, the Licence and the Codes.
Over the next few pages Lawyer Monthly examines these two countries approaches to the gambling industry.
