THE Premier Advice provided by Horsham District Council as the Primary Authority (PA) to members of the National Federation of Meat and Food Traders is ‘Assured’ by law through the Regulatory Enforcement Sanctions Act 2008. Tis ‘Assurance’ was tested


recently when Horsham received notification by a local

system developed by the business was insufficient and therefore was contravening Article 5 of Regulation (EC) No 852/2004. Because the scheme doesn’t


allow the local authority to proceed with its action for 5 working days, this enables all parties to liaise with one another in an attempt to resolve the issue informally. A few quick telephone


conversations were all that was required to bring the matter to a satisfactory conclusion. Te local authority informed me of the reason they believed that the business was in contravention and the action needed to comply with the law. Tis was followed up with a conversation with the business operator to give advice on the specific area of the Assured Advice they should be following and how to implement it into working practice. Once the business was


following the Assured Advice it became protected under the PA scheme and enabled me to advise the local authority that


their proposed action could not take place. Tere are 2 winners here;


the business did not receive the statutory notice, and, the local authority ensuring that one of their businesses achieved full legal compliance saving them the time and effort in serving the notice. Primary Authority facilitates conversations between local authorities and businesses to resolve matters such as this. It is unique as no other national scheme or process allows for disputes or proposed enforcement action to be resolved in this way. To ensure fairness there


is a process in place to allow local authority proposing to take legal action to challenge the PA if it considers that they were wrong to block the action. Tis is determined by the Secretary of Stare via the Regulatory Delivery Department. Evidence that PA is working


for business and local councils alike. If you are not yet signed up, do it today, it may prevent you receiving legal action. n
