DO YOU SERIOUSLY THINK THAT WHEN THE COUNTDOWN CLOCK TO THIS REGULATION HAS REACHED ZERO, THEY’LL ENFORCE IT? Unlikely to swoop on people on Day 1, and the authorities will probably allow some leeway provided that implementation can be shown to be in progress. But prosecutions will take place more than 100 to date under the existing Data Protection Act.
SURELY THIS ISN’T FAIR ON PUBLISHERS WHO CAN’T AFFORD TO MAKE THIS CHANGE TO THEIR BUSINESS? Perhaps this is something that a forward thinking printer like S&G can offer as a service to these publishers? Seriously what is proposed is generally good working practice and looking after a reader’s data should be part and parcel of the relationship between publisher and subscriber: “You can trust us with your data and not to pass personal details to unscrupulous third parties without your express permission to do so”.
SO WHO WILL POLICE IT? The Office of the Information Commissioner will be in charge and responsible to Parliament for investigating any breaches and mounting prosecutions that may follow. Whether there will be local offices, perhaps
something like Trading Standards, is not yet clear. Some of the fine detail has not been released.
THIS WILL OBVIOUSLY BENEFIT THE CONSUMER FROM BEING MASS EMAILED AND BOMBARDED WITH OFFERS THEY NO LONGER SUBSCRIBED TO, BUT CAN IT BENEFIT THE PUBLISHER AS WELL? Definitely. If companies can no longer carpet bomb with unsolicited emails, they may turn to on page advertising in sympathetic publications to reach an audience of prospects. Publishers will hold data about their readers that brands may not be able to access.
