Choosing someone to take care of your children in the event something happens to you and your spouse is an important decision. However, it is only the first step. Discussing with the potential guardians your wishes on how they should serve is just as important.


First- Ask the prospective guardian if they would be willing to serve. They may have already committed to others or have other circumstances, i.e. health concerns, that make accepting this role difficult.


Second- discuss the financial planning or arrangements that you have put in place for the care and maintenance of your children. This includes sharing with the potential guardian who you have named as the trustee of your children’s assets.


Third- provide the prospective guardian a list of family members and discuss your wishes regarding maintaining family relationships, i.e. which relative you would like to be involved in your children’s lives and which ones you feel strongly should not be involved (if applicable).


Fourth- provide the prospective guardian with key information including child’s medical information, family medical history,


,educational information, and where to find any of this key information in case of a tragedy.


Finally, you should make sure the prospective guardians are familiar with your children, their habits, routines and activities to make the difficult transition to life with the guardians as easy as possible for both the children and the guardians.


Once you have made the important decision of who should serve as the guardian for your children, you need to complete a basic estate plan to ensure your wishes become reality. In this plan, you will also have the ability to financially plan for the care and maintenance of your children, as well as choose a trustee to manage your minor’s assets and administer the plan for your children’s benefit.
