binding effect. The shop can’t have it both ways: The written warranty is either in effect or it’s not. The customer was no longer obligated to have the work done at the original shop or to contact the shop before having the repair work done by the other shop. But the shop was not relieved of its obligation to provide a product with a reasonable useful life.


• Also, the provisions excluding reimbursement for other expens- es, such as loss of use, incon- venience, lodging, etc. were of no effect, so the customer was awarded the $500 he requested.


Think about that! This case makes


a good argument for long term warran- ties. A written warranty is a contract that protects both the customer and the shop. Wouldn’t you rather keep the customer coming back to you? Even if the benefits of the war-


ranty decrease over the extended time and mileage (like a prorated battery or tire warranty), at least the customer is bound to comply with the terms and conditions of the contract, which, among other things, might include con- tacting your shop before any repairs are done elsewhere.
