In a jury trial where the jury found that the defendant officer was liable to plaintiff-appellant for malicious prosecution, the trial court granted partial judgment as a matter of law that punitive damages were unavailable because plaintiff-appellant had not presented sufficient evidence that the officer acted with actual malice. Plaintiff-appellant argues that the trial court committed reversible error by refusing to allow the jury to determine the credibility of the testimony presented and by failing to consider the evidence of actual malice in the light most favorable to the plaintiff-appellant. Plaintiff-appellant also argues that the trial court abused its discretion by allowing the presentation of drug evidence not obtained in connection with the arrest, and failed to take curative action.
