795-402 Jeffrey C. Smith v. Nancy Hassett

Robert J. Fuoco (410) 768-6733 Civil Procedure

Te Honorable Philip T. Caroom Circuit Court for Anne Arundel County

Tis case was brought by the buyer of a waterfront house against the seller, where the buyer alleged that the seller made misrepresentations and breached various warranties of title. Te questions presented in this appeal are whether the trial court erred in denying a motion for leave to file a second amended complaint, where the court ruled that the allegations in the second amended complaint were “futile”, and whether the trial court erred when it entered summary judgment against plaintiff ’s claim of a violation of the Maryland Consumer Protection Act.

796-02073 Clayton W. Hamilton v. Mayor and City Council of Baltimore

Scott M. Rotter (410) 783-9230 Public Employee Worker Compensation/Proximate Causation

Te Honorable Audrey J.S. Carrion Circuit Court for Baltimore County

Tis case revolves around a firefighter who sustained an injury to his shoulder due to a work-related accident. 2 years after that accident, the Maryland Workers’ Compensation Commission found, during a hearing, that the firefighter’s current shoulder complaints were causally related to the accident. Te firefighter appealed this decision to the trial court, which granted summary judgment against the firefighter. Te question presented in this appeal is whether the trial court committed reversible error by misapplying the standard of review for summary judgment or by failing to apply the holding of Williams Construction Company v. Garrison regarding subsequent intervening/superseding cause.

Te Honorable Herman Dawson Circuit Court for Prince George’s County

In a foreclosure proceeding against appellant, appellant alleges that the trial court erred when it failed to vacate the foreclosure sale and dismiss the foreclosure action because appellant had exercised his statutory rights to rescind the loan and contractual rights to arbitrate the issue.
