Docket No.: Civil Action No. 213221

Facts: Plaintiffs are several children who were passengers in a school bus. Defen- dant was landscaping company. The defendant’s truck was pulling a trailer which jack-knifed across the road and collided with the bus. Defendant conceded liability and mul- tiple plaintiffs contested during the trial for damage awards from the insurance carrier’s policy limits. Each group of plain-

tiffs contended that the other group had elevated their damages and numerous at- tempts at Mediation could not resolve the case.

Injuries and Damages: Plaintiff ’s coun- sel contended that 3 children they represented suffered TBI.

Plaintiff: Primary Experts: James Merikangus, MD, neurologist; Allen Mirsky, Phd, neuropsychologist; Stephen Mott, MD, pediatric neurologist

Verdict: $2.27 million

Insurance Company: Montgomery Mu- tual Insurance Co.

Special Remarks: Offer prior to trial $1.6 million.

* The court appointed a Special Master to conduct a trial and submit recom- mended damage verdicts to the Court for approval after hearing testimony. Court approved verdict awards entered by Spe- cial Master and the verdicts were paid in full. Case is closed. Extensive use of Power Point presentations during direct and cross-examination were invaluable. Coun- sel strongly recommends and has employed full time audio- visual specialist for all major trials.
