Mitchell A. Greenberg, of the Greenberg Law Office in Baltimore, received his J.D. from the University of Baltimore School of Law. He is a member of MTLA’s Board of Governors and serves as Vice-Chair of MTLA’s Trial Reporter Committee. Mr. Greenberg is a member of MTLA’s Membership Committee and serves as MTLA’s delegate to the Task Force for the Rehabilitation of Injured Workers. Raymond, et al v. Jack Kontgias Court/ Docket #: Circuit Court for Bal- timore City Case No.: 24-C-01-005507
Facts: The Complaint alleges that between 1993 and 1997, Jack Kontgias, a developer in Anne Arundel and Montgomery Coun- ties, repeatedly sexually molested his girlfriend’s daughter. After Mr. Kontgias plead guilty to sexual child abuse on Octo- ber 4, 2000, for repeatedly sexually molesting his former girlfriend’s daughter from the ages of 7 to 11, the victim filed a multi-count Complaint in the Circuit
Court for Baltimore City. The Complaint alleged that Mr. Kontgias repeatedly abused the victim while the victim’s mother was out of the house or asleep in another room. The abuse included playing the “tickle game” in which he would put his hands down the little girl’s pants and fondle her. According to a medical examination re- quested by the State’s Attorney’s Office in Baltimore City, the victim showed evidence of blunt penetrating trauma consistent with sexual child abuse. Also, the victim suffered severe physical and psychological trauma and severe mental anguish. The parties con- sented to a judgment being entered on the Assault Count in the amount of $450,000.00 in favor of the victim and in the amount of $25,000.00 on an Inten- tional Infliction of Emotion Distress Count
in favor of the victim’s mother. The Defen- dant continues to deny any wrongdoing.
Injuries/Damages: Severe physical and psy- chological trauma and severe mental anguish.
Settlement: The parties entered into a Con- sent Judgment in the amount of $450,000.00 in favor of the victim and $25,000.00 in favor of the victim’s mother.

Anonymous Plaintiffs v. Anonymous Defen- dant Physician and Anonymous Defendant Professional Association (#40)

Facts and Allegations of Liability: On November 6, 1997, based upon a referral from her primary care physician, the Plaintiff, a 67 year old woman, underwent screening mammography which revealed a new, focal increased density in the mid- left breast which was not present on her previous mammogram in 1995. Accord- ingly, the Plaintiff returned on November 18, 1997 for additional evaluation. It is alleged that the Defendant completed additional mammographic views and, in violation of the standards of care, failed to perform ultrasound or magnification views. Further, the Defendant negligently interpreted the mammograms to represent normal breast tissue.
