Facts: Jane Doe was sixty - six years old when she was admitted to ABC Hospital with end stage renal disease. During her hospitalization, she developed stage IV sacral decubitus ulcers. She died two months after admission of causes unre- lated to the ulcers Investigation of the medical records revealed that the nurses at ABC Hospital turned Jane Doe infre- quently prior to the development of the ulcers. Once the ulcers developed, the nurses and physicians failed to take ap- propriate measures to prevent the exacerbation of the ulcers. The family did not contact counsel until after Jane Doe’s death, and the family did not take pic- tures of the ulcers. Although the records did not describe the size, texture, or color of the ulcers, one of the records referred to the ulcers as Stage IV.


Injuries/Damages: State IV sacral decu- bitus ulcers.

Verdict/Settlement: The case was settled for the sum of $120,000.00.


Special Remarks: Although photographs are usually necessary to proceed with this type of claim, Plaintiffs were fortunate that one of ABC’s employees accurately described the stage of the ulcers.

Facts:␣ Plaintiff was a sixty - three year old male at the time of the accident. Approxi- mately two months prior to the accident, he was fitted with a leg prosthesis at Union Towne Orthopaedics located in Cumberland, MD. The locking pin for the prosthesis came loose, and the prosthesis came off, causing the plaintiff to fall and break his ankle. Inspection by Union Towne Orthopaedics did not reveal any defect. Defendant contended that the accident re- sulted from product misuse. The prosthesis was not preserved, and no photographs were taken of the locking mechanism.


Allegations of Liability:␣ Plaintiff alleged locking pin was defective.


Injuries/Damages: Broken ankle requir- ing surgery, but no residuals. Plaintiff had questionable life expectancy.

Facts/Synopsis: Sandra Sullivan was a twenty-three year-old nursing Student working part-time for Peninsula Regional Medical Center in Salisbury, Maryland. On January 15, 1998, she developed pain in her abdomen, nausea and vomiting, and went to the emergency room where a flat film was taken and read as negative by a physician’s assistant. However, the film showed the presence of a fecalith in the area of the appendix. The next day,

made that he should be admitted to ICU. Doctor on call notified and he ordered gastroenterology consult. GI specialist and ICU doctor both consult while decedent still in ER.


Allegations of Liability: All defendants failed to appreciate the fact that decedent was continuously bleeding and take ap- propriate measures. Plaintiff subsequently had arrest and died in ICU.


Injuries and Damages: please specify type of damages, past special, future special, etc.

Special Remarks: Plaintiff 64 years old re- tired with 5 adult children, 4 of whom were married. Funds placed in 468 Trust to avoid using Defendant’s broker for structure.
