taking the cause of private property rights and eminent domain. The issues are generally covered, but I have a suggestion. Having just gone through a long


and arduous negotiation on a pipe- line right of way, I found the re- mainder value of the property to be a major area of contention. Pipeline companies don’t think


a pipeline across your property re- duces the value of the remaining land. Real estate agents know it does reduce the sale price. Apprais- ers have diffi culty attaching a value to the reduction. An obvious way to correct this


quandary would be to treat this as we do mineral rights: that is, with a royalty on products transmitted. This would be dollar amount per barrel of petroleum per mile or frac- tion of a mile crossing your land. I would have this royalty remain with the land, not separable like mineral rights. The property owner would be


compensated for as long as he/she owned the land and would pass that continued compensation to future owners. The “guess” of the remain- der value would be solved and the landowner would feel more like a
