Introduction of parallel import and Bolar exemption


T e revised Patent Law has specifi ed for the fi rst time that parallel imports and the Bolar exemption are exempted from infringement.


According to the revised Patent Law, import of patented products or products made directly by using patented methods does not infringe the patents aſt er the products have been sold by the patentees or been authorised to be sold by the patentees. T is new change confi rms the ‘Exhaustion Doctrine’ in the Chinese Patent Law.


T e Bolar Exemption has also been introduced into the Chinese Patent Law. Acts for the purpose of providing information needed for obtaining regulatory approvals from the administrative authorities, including making, importing or using patented drugs or patented medical apparatus are specifi cally exempted from infringement. Accordingly, pharmaceutical companies are allowed to make, import or use patented drugs or patented medical apparatus for clinical tests in order to obtain the information necessary for the regulatory approvals prior to the expiry of the patents. However, China does not have any mechanism to prolong the


protection of patents relating to drugs or medical apparatus. T is change may reduce the duration of such patents to an extent.


Prior art defence


For the fi rst time, Chinese Patent Law establishes the principle of prior art defence in patent infringement and dispute cases, although this principle had been observed during infringement proceedings before the revised Patent Law 2008. If a defendant can provide evidence showing that the technologies or designs used by it were publicly available prior to the fi ling of the patent at suit, the acts of the defendant will be deemed not to constitute an infringement. T is will eliminate long invalidation procedures for defendants, and the courts do not need to wait for the Re-examination Board of the CPO to issue the results of invalidation proceeding. At the moment, Chinese courts are involved in infringement proceedings while invalidation proceedings are conducted separately by the Re-examination Board. ■
