insurance, arranging for and coordinating maintenance to the association property; and otherwise overseeing the day-to-day operations of the association.” [O.C.G.A. § 43-40-1 (4.2) — definition of “commu- nity association management services”] In other words, the CAM license allows an individual to perform community associ- ation management services, but only under the supervision of a broker. To become a salesperson, an individ-
ual must complete a 75-hour pre-license course, pass a state examination and then complete an additional 25-hour post-license course. A salesperson may perform any of the acts of a broker, but only when acting in behalf of a broker. So, can a salesperson perform com-
munity association management serv- ices? Yes..., and no. While it is true that a salesperson can perform any of the acts of a broker; and while it is true that a broker can perform community asso- ciation management services; O.C.G.A. § 43-40-25 (b) (25), requires that a licensee demonstrate competency. So, if a sales- person has completed the CAM pre- license course (perhaps to satisfy the post-license requirement) or has other- wise gained a reasonable level of com- petency, a broker may permit a sales- person to perform community associa- tion management services. Equally true, a broker should take
competency into consideration when considering permitting any affiliate li- censee (including affiliate brokers) to practice community association man- agement, property management or any other specialized area of practice. Bro- kers should also consider their own competency when permitting affiliate licensees to act in their stead. Some of the most common violations
