Fiscalía declara legal juego y apuestas online en el país


El Ministerio Público de Chile ha decidido cerrar la causa que buscaba declarar ilegal a las casas de apuestas en línea con presencia en Chile, y ante esta situación, ha fijado el día 11 de julio de 2025 para dar lugar a la audiencia donde se dará fin a un proceso que comenzó a finales de junio del 2022. La publicación de un escrito legal proveniente de la causa por el cierre de los negocios de apuestas online, del Ministerio Fiscal, donde Rossana Folli, fiscal adjunto de ÑUÑOA, dice: “Habiéndose rechazado la ampliación solicitada por esta parte en audiencia del día 04 de abril de presente y de conformidad con el artículo 248 letra c) del Código Procesal Penal, comunico a US. que esta Fiscalía, con fecha 11/ABRIL/2025, ha cerrado la presente investigación y ha decidido no perseverar en este procedimiento”,


Ante esta noticia, la Agrupación de Plataformas de Apuestas en Línea, emitió la siguiente Declaración Pública: “La Agrupación de Plataformas de Apuestas en Línea valora la decisión del Ministerio Público de “No Perseverar”, comunicada oficialmente este 14 de abril, en la investigación penal iniciada en 2021 respecto de la operación de plataformas de apuestas en línea en Chile.


“Esta decisión fue adoptada luego de que el 8º Juzgado de Garantía de Santiago ordenara el cierre definitivo de la investigación penal el pasado 4 de abril. Se trató de una indagatoria exhaustiva, liderada por el Ministerio Público, que se extendió por más de tres años, incluyó dos reaperturas y recopiló más de 3.000 fojas de antecedentes. La resolución ratifica la postura que el Ministerio Público ha sostenido desde el inicio: las apuestas en línea no están prohibidas en Chile ni constituyen un delito. Este pronunciamiento reafirma lo que, como agrupación, hemos defendido desde el comienzo: que las plataformas de apuestas en línea operan dentro del marco legal vigente, aunque aún no exista una regulación específica al respecto.


“Como agrupación, reiteramos la urgencia de avanzar hacia una regulación moderna, responsable y alineada con estándares internacionales, que resguarde los derechos de los consumidores, establezca reglas claras para los operadores y contribuya de manera efectiva y transparente al bienestar colectivo y al desarrollo del país. Reafirmamos nuestra plena disposición a colaborar activamente en la discusión legislativa en el Congreso Nacional y en los espacios técnicos necesarios para avanzar en una regulación robusta para Chile”.

Online gambling and sports betting are declared legal in the country


The Public Ministry of Chile has decided to close the case that sought to declare online bookmakers’ operations in Chile illegal, and in view of this situation it has set July 11, 2025 as the date to formally close the case on the process that began at the end of June 2022.


Chile’s Public Ministry published a legal document on the case to close online betting businesses, where Rossana Folli, deputy prosecutor of ÑUÑOA, says: “Having rejected the extension requested by this party in a hearing on April 4 of this year and in accordance with article 248 letter c) of the Code of Criminal Procedure, communicated to us that this Prosecutor’s Office, on 11/APRIL/2025, has closed the present investigation and has decided not to persevere on this procedure”, In response to this news, the Association of Online Betting Platforms issued the following Public Statement: “The Association of Online Betting Platforms values the decision made by the Public Prosecutor’s Office to “Do Not Persevere”, as officially stated on April 14, in the criminal investigation initiated in 2021 regarding the operation of online betting platforms in Chile.


“This decision was adopted after the 8th Court of Guarantees of Santiago ordered the ending of criminal investigations on April 4, which have been an exhaustive investigation, led by the Public Prosecutor’s Office, and has lasted more than three years, including two reopenings with more than 3,000 pages of background files. The resolution ratifies the position that the Public Prosecutor’s Office has maintained from the beginning: online betting is not prohibited in Chile, nor does it constitute a crime. This statement reaffirms what, as a group, we have defended from the beginning: that online betting platforms operate within the current legal framework, although there is still no specific regulation in this regard.


“As a business group, we reiterate the urgency of moving towards modern, responsible regulations aligned with international standards, which safeguards the rights of consumers, establishes clear rules for operators and contributes effectively and transparently to the collective well-being and development of the country. We reaffirm our full willingness to actively collaborate in the legislative discussion in the National Congress and in all technical spaces necessary to advance towards robust (online gambling and betting) regulations for Chile.”
