• Local franchise laws – domestically, we have no specific franchise laws. However, many countries have strict laws surrounding franchising, which you must adhere to. We can work with our network of overseas lawyers to ensure you do not fall foul of these
• Trademarks – ensure that you can register your trademarks in the relevant jurisdiction. If your partner is paying for the rights to use your brand, it will want to ensure you have adequately protected it
• Control – well-drafted agreements can give you a surprising amount of control, but you should also look for practical controls in the way you operate. You will need to establish methods to track important information
such as sales data through robust monitoring systems. You also need to build these into the package from the outset, thereby enabling you to keep a close eye on the performance of the business and ensure that you are receiving the correct payment from your franchisee
• Support – as with any franchise network you will need to provide the franchisee with an appropriate level of support to justify their management service fee payments to you. You will be advised to include regular visits, so you will need to ensure that your UK business can continue to operate while key personnel are absent, or, as you begin to grow in international exposure, recruit specifically for the purpose
• Flexibility – you and your team should be prepared to learn and adapt to different cultures and different ways of doing business – it’s a great experience
