Reducing the risk of being gazumped!
THE Law Society has announced radical new plans to reduce the risk of gazumping and speed up the process of buying a home. These include revolutionary new
breaks down. These two measures are part of a
proposals which, when fully devel oped, could solve the problem of property-buying chains, which cur rently dominate the conveyancing market and are often the root cause
of delay. Chains develop because most peo
ple must sell their present property before they can buy a new home. As such, homebuyers often become links in a chain which can only move at the pace of the slowest transaction - causing delay and frustration. Unfortunately, over the past 20

the Law Society - this time on Stan dard Mortgage Instructions - the Society is producing a streamlined specification for a model certificate of title, for use in conveyancing transac
designed to tackle the risk of gazumping, by ensuring a sellers' package is prepared before a house is

delay. To reduce delay even further, the
Law Society remains committed, wherever possible, to the continua tion of joint representation of both lender and borrower. As part of this, it is calling for mortgage lender requirements to be standardised and

Law Society’s Property and Com mercial Services Committee, said: "We strongly urge the Government's Homebuying Review Group to con sider this package of proposals, par ticularly the chain breaking mea sures, which will not only cut delays but could revolutionise the con veyancing market if they are taken forward. Freeing the residential prop erty market from chains is one of the most radical and innovative propos als to emerge to date and although further work is needed, initial Law Society analysis has clearly shown it could be achieved. Meanwhile, streamlining lenders' requirements and introducing a sellers' package should offer immediate benefits for
home buyers."
