Debt Collection Lawsuits In Florida, some self-storage operators have been hit with lawsuits for allegedly violating the Florida Consumer Collection Practices Act (FCCPA), a state law that aims to keep collection agencies and debt collectors from harassing its citizens through phone calls, threatening letters, and other unfair actions, especially when they are likely to be sleeping. Self-storage owner-operators in Florida are reminded that under Section 559.72(17) of the FCCPA, they are not permitted to send invoices, lien notices, late-fee notices, or rent notices to tenants via phone, text, or email between 9:00 p.m. and 8:00 a.m. “While we disagree with the application of this law against self-storage operators and managers, who are not debt collectors, until the courts have clarified the law, we would recommend that you update your notice policies to avoid sending texts or emails to tenants during those hours,” says Scott Zucker, a partner in the law firm of Weissmann Zucker Euster + Katz P.C. Additionally, rental agreements could be updated to include language that would permit the operator to contact the consenting tenant at any time.
