ATI battle far from over The European Parliament is in the final stages of negotiating its position on the proposed overhaul of the type European car type approval and market surveillance system. The proposed regulation would lead to stricter supervision of tests done before a car can be placed on the market and more stringent obligations on EU member states to check that those already on the road meet all EU safety, environmental and production requirements.


Provisions relating to access to repair and maintenance information are of course of great importance to the lubricants industry. UEIL has been in close contact with leading MEPs to ensure that the text leaves no room for doubt as to OEMs’ legal obligations already set down in the Euro 5/6 pollutant emission legislation that entered into force in 2009. Thanks to UEIL’s outreach efforts, important amendments have been tabled to improve the original text.


The battle is however far from over. The Internal Market and Consumer Protection committee vote on 26 January will be decisive. UEIL is meeting with MEPs to gather support for clear rules regarding access to technical information and a stronger emphasis on enforcement. The final outcome will be the result of so called trilogue discussions between the Parliament, the EU Member States (Council) and the European Commission.


UEIL to respond to consultation on REACH In the light of the European Commission’s ambition to make EU legislation fit for purpose, the executive body is now conducting an evaluation of the REACH Regulation. Through a consultation it seeks to obtain feedback from stakeholders as to how the Regulation’s objectives have been achieved in order to improve the implementation of the law and to consider modifications.


UEIL has the intention to respond to the consultation and to provide the Commission with its comments.


At first glance, UEIL finds that REACH does not encourage innovation sufficiently, and that it creates too much unpredictability regarding access to raw materials.


Although UEIL does not believe the REACH regulation should be reviewed in itself, as this would only create uncertainty for business, the industry is convinced that the enforcement of the Regulation should be enhanced through more effective measures at national level (improving assistance to SMEs, education, e.g.).


In terms of next steps, the evaluation takes place in parallel with the fitness check on the most relevant chemicals legislation and will serve as an evidence base for a Commission report on chemicals as well as the non-toxic environment strategy which should be developed by 2018.


Fiscal issues


The Commission published its proposal to include lubes in bulk under EMCS in September 2016 and asked the EU Member States to provide their opinions through a written procedure. UEIL lobbied the last months of 2016 intensively and our hard work had success as 4 EU Member States (UK, France Spain and The Netherlands) voted against the Commission proposal therefore creating a blocking minority. Therefore the Commission proposal was rejected in 2016.


However Germany is not giving up to address the issue of lube fraud at EU level in 2017 and is trying to convince other EU

Member States to agree to include only light lubes under EMCS. If Germany manages to convince one of the 4 EU Member States that rejected the Commission proposal, it will ask the current EU Presidency (Malta) to include the inclusion of light lubes under EMCS at the next Excise Meeting in March 2017 (date tbc.).


UEIL will actively monitor the situation in the coming months and set up meetings with the fiscal attaches of France, UK, Spain and The Netherlands to prevent that any of these countries will change positions and agree to include light lubes under EMCS at the next Excise Committee in March.

It is envisaged that several more OEM Bulletins will be issued over the next few months.


On Tuesday 22 November 2016 a meeting was held in Brussels with B Otterholm of Volvo Group Trucks Technology and TH Bates & JD Jong of UEIL, to discuss Volvo Hybrid Engine Oil requirements.


The Technical Committee is currently investigating: • Industrial - 1 Case + (1 case has been transferred to the CC) • Off Highway - 7 Cases + (2 cases have been transferred to the CC) • PCMO - 6 Cases + (2 cases have been transferred to the CC) • HDDO - 0 Cases • Two Stroke - 2 cases


The last Technical Committee meeting was held in Brussels on 25 January 2017.
