ourt is the essence of the WTO, guaranteeing that international rules negotiated over many years are observed. But. But since mid-December 2019 it has had no teeth. The court, which in the past had seven presiding judges fu


judges, had to make do with the last three remaining judges last year. But after two terms expired and further to a US veto on new appointments, the court is now dead in the water. Effectively the US has ended an era in which the world trade system was of a binding nature, plunging the WTO into its deepest crisis since its founding in 1995. And the future does not look bright. The European Union has announced legislation which opens the way for it to retaliate in trade issues without WTO in ervention while the US is acting to enforce its rules in bilateral agreements, as it has with China. Without clear rules and a court of appeal, it is likely that nations will resort to tariffs and sanctions to restrict imports. In the end, this will hurt everyone.
