Can your Farm Business Survive Succession?


The most significant asset of a farm is the land (including property and buildings). Without land holdings (purchased or leased), the farm business cannot operate. This is an obvious statement but it is surprising the number of issues that arise relating to the status of the land and which prevent a business from being operated effectively.


With farms passing through generations, it is very easy for intentions to become diluted within the legal documents. It is vital to check your title deeds to ensure that your land is registered correctly - do not assume.


Some common issues arising from incorrectly registered land on succession;


a. Land is not held in the name of the entity that utilises it. Ensure that your business and the land are tied together. It is essential that the control / ownership of the farming business and land are complementary. This is a fundamental point. The business cannot operate without the use of the land and conversely the value and amenity of the land becomes disadvantaged without occupation and utilisation of the business.


b. Be certain as to the type of tenancy that you hold over the land and know who the tenant is. Is it the individuals or the business? If you hold the land in an individual name but you intend for the business to be the tenant then consider an assignment. Different tenancies attract different rights and obligations and it is essential that you act appropriately to secure the land for future generations and to safeguard the farm business.


c. Many titles are held in joint names and it is often thought that by severing the title, that one of the parties falls away. This is not the case. The legal title cannot be severed, only the equitable and so it is essential that you seek legal advice if you wish to remove a party from the Deeds entirely.
