Following are steps to help protect you and your business from a lawsuit:


1. Educate managers, supervisors and employees on what constitutes discrimination and what does not.


2. Create a workplace culture that encourages tolerance and respect for one another. 3. Take immediate action regarding any claims or evidence of inappropriate behavior. 4. Treat all complaints confidentially.


5. Develop an anti-discrimination policy. Include it in your employee handbook and make sure it is properly enforced.


6. Don’t retaliate against an employee who has filed a complaint. This will only make the situation worse.


7. Seek the advice of a Human Resources professional or an attorney who specializes in employment matters to help guide you through the process of dealing with a complaint.


8. Make sure your insurance policy includes discrimination and ligation coverage.


Don’t think this won’t happen to you. Two Association members have faced discrimination lawsuits in the last two years. In one case the dealer was found not liable for discrimination, but legal fees topped $1 million dollars.


When you proactively address employment discrimination, you can reduce your exposure to lawsuits and protect your bottom line.
