Whether the Maryland Commercial Electronic Mail Act, which prohibits the transmission of commercial email with false information, regard- ing its subject and origin in an effort to limit “SPAM” is unconstitutional and in violation of the dormant commerce clause because it regu- lates conduct occurring wholly outside of Maryland? The trial court declared the Mary- land Commercial Electronic Mail Act unconstitutional and the Plaintiffs appealed that decision.
