factors to take into consideration when entering into a
franchise agreement, either as the franchisor or the franchisee and these can vary depending on the type of business. The following points are a guideline to ensure the relationship and business practices are established correctly from the outset.

• Initial fee – It is usual for the franchisee to pay an initial fee to purchase the franchise. The level of fee varies depending on the nature of the business. The franchisor may provide the franchisee with an initial ‘pack’ including stationery, products and equipment required for the operation of the business.
• Continuing fee – Generally
speaking, this is an ongoing ‘licence fee’. This is often paid monthly and can be fixed or calculated by reference to sales.
• Term of agreement – Often a franchise is granted for a fixed initial period (eg five years) with rights for the franchisee to renew at the end of that period.
• Rights to renew – Usually the franchisor will be happy for the franchisee to continue the franchise and will allow the franchisee an option to
