The employer must notify both the IRS and the provider of the amount of the excess benefit each provided. Coverage providers are expected


to charge back the excise tax to the employer. The amount of the tax is not to count towards the aggregate cost of coverage. The Cadillac tax is not deduct- ible; accordingly, when the provider passes the cost back to the employer as an additional fee, that amount will be “grossed up” in order to compensate for taxes providers will owe on the fee. This Guidance is preliminary, and

that runs double 53-foot trailers was having issues with the ABS ECU work- ing properly on the rear trailer. Using the 920 ABS menu, a technician can run the TMC RP 137 test that compares the voltage at the nose of the first trail- er with the voltage level at both trailers’
