Issues


The Public Service Commission promulgated a regulation permitting the commission to decide whether there has been an overcharge or undercharge for regulated services and to make a monetary award accordingly. The issue is whether this regulation violates Article 23 of the Maryland Declara- tion of Rights by denying a consumer’s right to trial by jury. In this case, the Public Service Commission awarded the power company more than $100,000 against the appellant, determining issues of disputed fact without a jury.
